Terms of Use

Please read these terms carefully. They govern your use of Haircolor AI, including subscriptions, acceptable use, and important disclaimers.

1. Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and Haircolor AI ("Haircolor AI," "we," "us," or "our") governing your access to and use of the Haircolor AI mobile application and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Haircolor AI is a professional tool that lets colorists and stylists photograph hair, receive AI-assisted readings of level and tone, generate and edit color formulas, and store client color history, photos, notes, and scheduling. The Service is intended for use by professionals exercising their own skill and judgment.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at info@jhobbie.com of any unauthorized use.

4. Subscriptions, Pricing, and Billing

The Service is offered on a paid subscription basis. We do not offer a free trial. The following subscription options are available:

  • Weekly: $1.99 per week.
  • Monthly: $4.99 per month.
  • Annual: $49.99 per year.

Your subscription unlocks unlimited AI color reads, formula generation, client timelines, before-and-after galleries, and scheduling.

Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period, at the then-current price for your plan. You can manage or cancel your subscription at any time in your Apple ID account settings after purchase.

Prices are stated in U.S. dollars and may vary by region and over time. We reserve the right to change subscription pricing; changes will not affect the period you have already paid for.

5. Cancellations and Refunds

You may cancel your subscription at any time through your Apple ID account settings, and your access will continue until the end of the current billing period. Except where required by law, payments are non-refundable and partial periods are not refunded. Purchases made through Apple are subject to Apple's applicable terms and refund policies.

6. License and Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your professional purposes. You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract the source code, except where permitted by law.
  • Use the Service for any unlawful, infringing, or harmful purpose.
  • Upload content you do not have the right to use, or that violates the rights or privacy of any person.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.

7. Your Content and Client Information

You retain ownership of the content you create or upload, including photos, formulas, and notes ("Your Content"). You grant us a limited license to host, store, and process Your Content solely to provide and improve the Service for you.

You are solely responsible for Your Content and for obtaining any consents required from your clients before capturing, storing, or using their photographs or personal information in the Service. You represent that you have all rights and permissions necessary for Your Content and its use within the Service.

8. AI-Generated Suggestions and Professional Judgment

The Service uses artificial intelligence to read hair and suggest formulas. These suggestions are estimates provided as a starting point and may be inaccurate or incomplete. They are not a substitute for your professional training, judgment, strand testing, manufacturer instructions, or applicable safety practices.

You are responsible for evaluating the hair's condition and history, conducting appropriate patch and strand tests, following product manufacturer guidance, and determining whether any formula is safe and appropriate before performing a service. We are not responsible for results, damage, allergic reactions, or other outcomes arising from your use of AI suggestions or the Service.

9. Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by Haircolor AI or its licensors and is protected by intellectual property laws. Except for the limited license granted to you, these Terms do not transfer any rights in the Service to you.

10. Third-Party Services

The Service relies on third-party platforms and services. These include Apple, for distribution and payment processing, and OpenAI, which powers the AI color read feature: when you use that feature, the photo and related text you submit are sent to OpenAI for processing, as described in our Privacy Policy. Your use of those services is subject to their respective terms, and we are not responsible for third-party services.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI suggestions will be accurate or reliable.

12. Limitation of Liability

To the maximum extent permitted by law, Haircolor AI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Haircolor AI and its affiliates from any claims, damages, liabilities, and expenses arising from Your Content, your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including your clients.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and cancel your subscription at any time. Provisions that by their nature should survive termination will survive.

15. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which Haircolor AI operates, without regard to conflict-of-laws principles, except where local consumer protection laws require otherwise.
